Power of attorney

Fill in the fields and the power of attorney takes shape alongside, with who grants the powers, who receives them, what those powers are and for how long. Available in Portuguese, English or Spanish. When you are done, print it, and your browser's print dialog offers save as PDF.

Read this before using it: a power of attorney for acts requiring special form, such as selling or mortgaging property, must be made by public deed or authenticated document, with the signatures witnessed in person. This builder produces a simple power of attorney, fine for ordinary acts; for the others the document will not do, and the notary will refuse it.
How it works

Three steps, nothing to install.

Everything runs on your own computer, start to finish.

1

Identify both people

Who grants the powers and who receives them, with name, tax number and contact. A power of attorney with incomplete identification is refused at any counter.

2

Write the powers and the term

What the other person may do on your behalf, and until when. This is the field that decides everything, and the section below explains why.

3

Print or save

The document is already finished alongside. Hit generate and pick your printer, or save as PDF from the print dialog itself.

Write the powers out one by one

The temptation is to write to deal with whatever is necessary. That is a bad idea both ways: a strict counter refuses it because the specific act is not there, and a lax one accepts it and the person ends up holding powers nobody meant to grant. List them: collect document X, sign application Y, represent me at meeting Z.

Set a term

A power of attorney with no end date lasts until revoked, and revocations get forgotten. A short term forces renewal when genuinely needed, and closes the door by itself once the matter is over.

Revoking is not tearing up the paper

While the other person holds the document and the third party does not know of the revocation, acts they carry out may still bind whoever granted it. Revoking properly means notifying the attorney and the organisations where it was used, in writing, and keeping proof.

Limits, said upfront

It does not witness signatures

Many organisations require the grantor's signature to be witnessed in person, by a notary, lawyer, solicitor or registry office. The builder prints; witnessing is done in person and cannot be added afterwards.

It does not cover everything

Acts requiring a deed or an authenticated document (property, some corporate operations) are out, and the box above says which. Banks, insurers and tax offices usually have their own forms, and in those cases theirs is the one that counts.

It is a generic template, not legal advice

Written from common Portuguese practice. Powers that are broad, long-lived or concern valuable assets deserve review before signing. The document carries that warning printed in the footer.

Questions

Questions about the power of attorney.

Do I really need a notary?

It depends on the act. To collect a document, deal with a registration or represent someone at a meeting, a simple power usually suffices. To sell a property it does not, and there is no way round it. Ask the organisation where you will use it beforehand.

Can it be granted to more than one person?

It can, but say whether they act jointly or separately. If you do not, you create an ambiguity the counter will resolve in the most cautious way, which usually means requiring both.

How long does it last?

As long as the term you write. With no term, it lasts until revoked, which is rarely what anyone wants.

Do I need an account?

Yes. Each document costs one euro, as a one-off purchase: you pay for that document and there is no monthly fee. The account is created by magic link, with no password. The declaration opens without paying, one a day.
